Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of folliculate.com and any related services, content, features, and communications provided by Folliculate ("Folliculate," "we," "us," or "our") (collectively, the "Services").
Please read these Terms carefully. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Acceptance of These Terms
By using the Services, completing the Folliculate assessment, submitting information, or clicking a button or checkbox indicating acceptance, you confirm that you have read, understood, and agree to these Terms.
If you use the Services on behalf of another person or organization, you represent that you have authority to accept these Terms on their behalf.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement.
The Services are intended for users who are legally permitted to access them in their country, state, or jurisdiction. We may restrict or refuse access where providing the Services would violate applicable law.
3. Description of the Services
Folliculate provides an assessment designed to learn about your hair condition, daily routine, preferences, and budget. Based on the information you provide, we generate personalized treatment or product recommendations and explain why an option may fit your responses.
Some assessment questions are safety-screening questions (for example, asking whether you are pregnant or experiencing patchy hair loss). If your responses indicate that a screened circumstance applies to you, we will not generate a product or treatment recommendation. Instead, we will direct you to consult a licensed healthcare professional. This screening step is a general precaution and is not a medical evaluation, diagnosis, or clinical judgment about your health.
Folliculate provides general information and matching services only. Folliculate is not a medical practice, pharmacy, telehealth provider, healthcare provider, or treatment provider. We do not diagnose conditions, prescribe medication, provide medical care, or replace advice from a qualified healthcare professional.
If you are interested in a prescription treatment or clinical service, you may be directed to an independent licensed telehealth provider or other third-party provider. Any consultation, diagnosis, prescription, treatment decision, purchase, shipment, or other service provided by a third party is governed by that provider's own terms and policies. Folliculate is not responsible for the services, advice, products, conduct, or decisions of those third parties.
4. Recommendations and No Medical Advice
Our recommendations are based on the information you choose to provide and the matching criteria available to us at the time you complete the assessment. They are not a diagnosis or a guarantee that a particular treatment or product is appropriate for you.
Where our safety screening indicates that we should not provide a recommendation, the absence of a recommendation is not a diagnosis, a statement about your health status, or medical advice of any kind. It means only that Folliculate has determined it is not appropriate for us to suggest a product or treatment based on your responses.
You should speak with a qualified healthcare professional before starting, stopping, or changing any treatment, medication, supplement, or healthcare routine. This is especially important if you have a medical condition, take medication, are pregnant or breastfeeding, or experience sudden, severe, or unexplained hair loss.
Seek prompt medical attention for urgent or concerning symptoms. Do not rely on the Services for emergency or time-sensitive medical decisions.
Results vary from person to person. Folliculate does not guarantee that any product, treatment, provider, or recommendation will be effective, safe, suitable, or produce a particular result.
5. User Information and Responsibilities
You agree to:
- Provide information that is accurate, complete, and current
- Update information when it changes or when necessary to keep it accurate
- Answer assessment questions honestly and to the best of your knowledge
- Review product and treatment information before making a decision
- Obtain professional medical advice when appropriate
- Use the Services only for lawful purposes
- Comply with all applicable laws and third-party terms when using the Services
You are responsible for your decisions based on the Services and for any information you provide. You should not submit information about another person unless you are legally authorized to do so.
6. Email Communications
If you provide your email address, we may use it to send you assessment results, service-related messages, responses to your requests, updates to these Terms or our Privacy Policy, and other communications relating to the Services.
Where required by law, we will ask for your consent before sending promotional or marketing emails. You may unsubscribe from marketing emails at any time by clicking the unsubscribe link in the message or contacting us at help@folliculate.com.
Unsubscribing from marketing communications will not necessarily stop service-related, transactional, legal, or security communications that we are permitted or required to send.
7. Third-Party Providers
The Services may include links, referrals, or connections to independent third parties, including:
- Licensed telehealth providers
- Hair-treatment product manufacturers
- Pharmacies or other treatment providers
- Fulfillment or shipping partners
Folliculate does not provide the services of these third parties and does not control their availability, prices, products, professional advice, treatment decisions, shipping, privacy practices, or terms.
A third party may require you to create an account, provide additional information, accept separate terms, or provide separate consent before receiving its services. You are responsible for reviewing those third-party terms and privacy notices.
Any relationship, transaction, consultation, or communication between you and a third party is between you and that third party. To the fullest extent permitted by law, Folliculate is not responsible for any loss, injury, damage, or dispute arising from your dealings with a third party.
8. Affiliate Disclosure
Folliculate may earn a commission when you purchase a product or service through certain links on the website. These affiliate relationships do not increase the price you pay.
We aim to provide recommendations based on the information you provide and our matching criteria. An affiliate relationship does not guarantee that a product or provider is suitable for you, effective, safe, or medically appropriate. Affiliate commissions do not influence our safety-screening outcomes; we do not provide a recommendation, and no affiliate link or partner offer is presented, whenever our safety screening indicates that one should be withheld.
Affiliate disclosures will be presented clearly and near relevant recommendations or links where required by applicable law. The existence of a commission does not replace your responsibility to evaluate a product or service and seek professional advice when appropriate.
9. Acceptable Use
You may not use the Services to:
- Violate any law, regulation, or third-party right
- Submit false, misleading, fraudulent, or unlawful information
- Impersonate another person or misrepresent your identity or affiliation
- Attempt to gain unauthorized access to the Services or related systems
- Interfere with or disrupt the Services or their security
- Introduce viruses, malware, or other harmful code
- Scrape, copy, harvest, reproduce, or systematically collect content or data without our permission
- Use automated systems or tools to access the Services in a way that places an unreasonable burden on them
- Reverse engineer, decompile, or attempt to discover the source code of the Services, except where applicable law permits it
- Use the Services to provide medical care or make medical decisions for another person
- Use the Services to advertise, promote, or sell products or services without our prior written permission
We may investigate suspected violations and take appropriate action, including suspending or terminating access.
10. Intellectual Property
The Services and their contents, including text, graphics, logos, designs, software, assessment questions, recommendations, explanations, and other materials, are owned by or licensed to Folliculate and are protected by intellectual-property and other applicable laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Services for your personal, non-commercial purposes.
You may not copy, modify, distribute, sell, license, publicly display, create derivative works from, or exploit any part of the Services without our prior written permission.
"Folliculate" and related names, logos, designs, and marks may be trademarks of Folliculate. You may not use them without our prior written permission.
11. Privacy
Our collection and use of personal information are described in our Privacy Policy. By using the Services, you acknowledge that you have reviewed the Privacy Policy.
Some assessment responses, including responses to safety-screening questions, may reveal or allow us to infer information relating to hair loss, health, pregnancy, appearance, sex, or other sensitive matters. You should review the Privacy Policy for information about how this data is collected, used, shared, retained, and deleted, including the specific protections that apply to safety-screening responses.
12. Service Availability and Changes
We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice. We are not required to maintain or support any particular feature, recommendation, product link, or provider connection.
We may update, correct, or remove content, recommendations, links, safety-screening criteria, or other information when we consider it appropriate. We do not guarantee that the Services or their content will always be available, complete, accurate, current, or free from errors.
13. Disclaimers
To the fullest extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, Folliculate disclaims warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and any warranty that the Services will meet your requirements or produce a particular outcome.
We do not warrant that:
- The Services will be uninterrupted, timely, secure, or error-free
- Recommendations will be suitable for your individual circumstances
- Any treatment or product will be available, effective, safe, or affordable
- Our safety-screening questions identify every circumstance in which you should consult a healthcare professional before using a product or treatment
- Information provided by third parties is accurate or complete
- Defects or security issues will always be detected or corrected
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited under applicable law. If you are a consumer in the European Union or another jurisdiction with mandatory consumer protections, those protections continue to apply.
14. Limitation of Liability
To the fullest extent permitted by law, Folliculate and its owners, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to:
- Your access to or use of, or inability to use, the Services
- Any recommendation, content, product, treatment, or provider
- Any information you submit
- Your dealings with a third party
- Any unauthorized access, interruption, error, or security incident
regardless of the legal theory and even if we were advised that such damages were possible.
To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid to Folliculate for the Services during the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).
This section does not limit liability that cannot legally be limited, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where such limitation is prohibited by law.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Folliculate and its owners, officers, employees, contractors, affiliates, licensors, and service providers from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
- Your use or misuse of the Services
- Your breach of these Terms
- Information you submit or transmit through the Services
- Your violation of any law or third-party right
- Your dealings with any third-party provider
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense of such claims.
16. Termination
You may stop using the Services at any time.
We may suspend or terminate your access to the Services if we reasonably believe that you have violated these Terms, created a risk to us or another person, or used the Services unlawfully. We may also terminate or suspend access where necessary to protect the Services, comply with law, or discontinue the Services.
Upon termination, your right to use the Services will end. Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law.
17. Changes to These Terms
We may update these Terms from time to time. When we make changes, we will post the updated Terms and revise the Effective Date above.
If a change materially affects your rights or obligations, we will provide additional notice where required by law. Your continued use of the Services after the updated Terms become effective means that you accept the changes. If you do not agree to the updated Terms, you must stop using the Services.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, except where mandatory consumer-protection laws in your place of residence apply.
Before starting a formal proceeding, you agree to contact us at help@folliculate.com and give us a reasonable opportunity to resolve the dispute informally. If we cannot resolve the dispute within 30 days, either party may pursue available legal remedies.
To the fullest extent permitted by law, any dispute arising out of or relating to these Terms or the Services will be resolved through individual, binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies and may seek temporary or injunctive relief for intellectual-property infringement or unauthorized access. Information about the AAA and its rules is available at adr.org.
You and Folliculate agree that disputes will not be brought as class, collective, or representative actions, to the extent this waiver is permitted by applicable law. Nothing in this section prevents consumers in the European Union or another jurisdiction from using mandatory local courts, regulators, alternative dispute-resolution procedures, or other rights that cannot legally be waived.
19. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other terms expressly incorporated by reference, constitute the entire agreement between you and Folliculate concerning your use of the Services.
They replace any prior or contemporaneous understandings relating to the same subject matter. If there is a conflict between these Terms and a separate written agreement signed by Folliculate, the signed agreement will control for the subject matter of that agreement.
21. No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to enforce that provision later. Any waiver must be in writing and signed by an authorized representative of Folliculate.
